Hevway Pty Ltd and its affiliates (“Hevway”, “us” or “we”) offers crane and heavy vehicle mapping and GPS navigation services to users through our mobile-based application (“App”) and our website (“Website”) (together “Services”). Within this Privacy Policy, a reference to ‘you’ means the customer, user or such other persons who are legally and contractually entitled to use our Services and who are protected by the Privacy Act 1988 (Privacy Act).

This Privacy Policy sets out how we use and protect any information that you give us when you use our Services.

We reserve the right to change this Privacy Policy and any updated versions of it will be available on the App and the Website.

Why we collect your personal information and data?

We collect your personal information and data to maintain, develop and improve the Services. 

This includes:

  • contact you.
  • use your location and route information and/or search query history to provide navigation services and safe route choice.
  • use data for analytics and measurement to understand how you use our Services. We review data to improve and measure the usability and effectiveness of the Services. 
  • communicate, by sending you notices, updates and additional information related to the Services. This include via push notification on the Website and the App, email address and SMS.
  • send you promotional and/or marketing materials. However, we will only do this subject to receiving your express consent, which you can revoke at any time. You can do this by selecting to “unsubscribe” or “opt-out” from the various types of emails that we may send to you. 
  • help improve the safety and reliability of our Services. This includes detecting, preventing, and responding to health and safety risks, technical issues that could harm Hevway, our users, or the public.
  • comply with our legal, professional and statutory obligations at all times, including as required under the Privacy Act. 
  • detect abuse or unauthorised use of our Services or any other use which we deem contravenes our Terms and Conditions. 
  • handle breakdowns and malfunctions in the provision of the Services. 

What personal information and data do we collect?

We collect your contact and personal information, such as your name, billing details, email address, telephone and phone number. This account information is necessary for setting up and monitoring your use of the App and the Website. 

We collect information that you share with us. This includes previous routes that you take.  This also includes information that you have provided to facilitate the effective use of the Services, such as crane weights, dimensions and sizes, cargo information and crane makes or models. Our Terms and Conditions set out your responsibility for ensuring the correctness of this information at all times. 

We collect time, location and route information. We utilise GPS signals and time-stamps, your IP address and other sensors and receivers on the device on which our App is installed and used, including accelerometer and compass to simulate routes and improve our navigation system. The types of data we collect may depend on your user, device or account settings. 

We collect information about the use of our Services from the device on which the App is installed. This includes:

  • collecting and recording how often you use our Services and for how long, your device type, unique identifiers, operating system type and version, battery usage, any third-party web pages or applications you visit or use or interact with our Application.
  • the Internet Protocol (IP) address and the name of the domain that serves you to access the Services, and the location of the device that you are using.
  • information about the interaction of your device with our Services, including, crash reports, system activity, and the date, time, and referrer URL of your request.

Our App and Website will use cookies to store information. Some of these cookies are essential to allow us to provide the Services to a high standard and us to improve the user experience. We also use cookies for security purposes. You can change the settings for your cookies within your browser.

Sharing your personal information and data

We will not sell, licence or lease the use of your personal information. We will not share your contact details with any advertisers or third parties for commercial gain. 

We may be required to share your personal information or data: 

  • if we believe that you have breached our Terms and Conditions or abused your rights to use the Services.
  • if we believe that we are required by law to share or disclose your information.
  • in a dispute or legal proceeding in relation to the provision of the Services by us, or use of the Services by you.

We may share data that you provide to us to third-party vendors who require that information to provide their services to us. We only do this to the extent necessary to provide our Services to you. We share data with third-parties that make tools to help us run our operations. We carefully select each of our partners and review their privacy commitments to ensure that your personal information and data is maintained.

We take all reasonable steps to protect your personal information from misuse, interference, loss, unauthorised access or modification or disclosure. Personal information and data is stored in accordance with this Privacy Policy, for future retrieval in accordance with our statutory obligations and good business practice.  Hevway will take reasonable steps to ensure that the information is de-identified and destroyed once we are no longer need, or are required to hold your information.

You may ask us for access to your personal information. 

If you believe that information in our possession is incorrect or incomplete, please write to us as soon as possible. We will take reasonable steps to correct any information found to be incorrect.
